International Family ADR

International Family ADR regarding the Hague Convention

On April 1, 2014, the Convention on the Civil Aspects of International Child Abduction (the "Hague Convention") comes into force in Japan.
The Arbitration & Mediation Center of the Dai-Ichi Tokyo Bar Association, one of the three local bar associations in Tokyo, now provides services to facilitate resolution of disputes regarding the Hague Convention (the "International Family ADR").

What is the "International Family ADR"?

The International Family ADR proceeding (the "ADR") will be conducted by two mediators. The mediators facilitate the ADR as fair and independent third parties, carefully listen to the views of both parents, and seek to resolve the dispute on an amicable basis by looking for points agreeable by both parents. The mediators are appointed from candidates consisting of experienced lawyers, retired judges, and academics. The ADR is managed as a private and confidential proceeding.
The Ministry of Foreign Affairs of Japan ("MOFA") will support the ADR. Such support includes the contribution of funds covering certain costs of the ADR.
